1. Acceptance of Terms

By accessing or using Streamash ("Service"), operated by Streamash LLC, a limited liability company registered in the State of Wyoming, USA, with its registered address at 30 N Gould St, STE R, Sheridan, WY 82801, USA, you agree to be bound by these Terms of Service ("Terms"). These Terms govern your use of the Streamash mobile application, website, and all related services.

2. Eligibility

To use Streamash, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using cryptocurrency services under applicable laws
• Not be located in a jurisdiction where cryptocurrency or NFT services are prohibited

3. Description of Services

Streamash provides:

• A non-custodial Solana wallet for managing SOL and ASH tokens
• NFT minting capabilities for video, image, and audio content
• A reward system where users receive ASH tokens for viewing NFT content
• An NFT marketplace for buying and selling digital collectibles
• Token swap functionality via Jupiter DEX integration

4. Wallet & Security

Streamash provides a non-custodial wallet, meaning:

• You have full control and ownership of your private keys
• We never have access to your private keys or mnemonic phrase
• You are responsible for all activity conducted through your wallet

5. NFT Minting & Marketplace

Minting

• You represent that you own or have rights to all content you mint as NFTs
• You are responsible for any intellectual property violations
• Minting fees (blockchain gas fees) are non-refundable

Marketplace

• All sales are final and processed on the blockchain
• Streamash uses an escrow system for secure transactions
• We may charge marketplace fees on successful sales

Ownership

Purchasing an NFT grants you ownership of the token on the blockchain. Unless explicitly stated, this does not transfer copyright or other intellectual property rights in the underlying content.

6. Reward System

The ASH token reward system operates as follows:

• Viewers receive 40% and creators receive 60% of distributed rewards
• Rewards require energy consumption (10 energy per view, maximum 100 energy)
• Energy regenerates over time (10 energy per hour)
• We reserve the right to modify reward rates, distribution mechanisms, and energy systems at any time

7. Prohibited Conduct

You agree NOT to:

• Upload content that infringes intellectual property rights
• Upload illegal, harmful, threatening, abusive, or objectionable content
• Manipulate or game the reward system through bots, scripts, or fraudulent activity
• Attempt to reverse engineer, hack, or compromise the Service
• Use the Service for money laundering or terrorist financing
• Create multiple accounts to circumvent restrictions
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations

8. Intellectual Property

The Streamash name, logo, app design, and underlying technology are owned by Streamash and protected by intellectual property laws. You may not copy, modify, or create derivative works without permission.

User-generated content remains the property of the creator. By uploading content, you grant Streamash a non-exclusive license to display, distribute, and promote your content within the Service.

9. Risks & Disclaimers

• Token values (ASH, SOL) can fluctuate dramatically and may become worthless
• NFTs may lose value or become illiquid
• Blockchain transactions are irreversible - errors cannot be undone
• Smart contract bugs or exploits may result in loss of funds
• Regulatory changes may affect the legality or availability of our services

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. STREAMASH DISCLAIMS:

• Any warranty of merchantability or fitness for a particular purpose
• Any guarantee of uninterrupted, secure, or error-free operation
• Any responsibility for third-party services (Jupiter, MoonPay, IPFS, Solana network)
• Any liability for blockchain network issues, delays, or failures

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAMASH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, TOKENS, OR NFTS.

Our total liability shall not exceed the amount of fees you paid to Streamash in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Streamash, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. Upon termination:

• Your right to use the Service ceases immediately
• Your on-chain assets (NFTs, tokens) remain in your wallet
• We may retain data as required by law or for legitimate business purposes

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via the app or email. Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the Service.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the competent courts of Sheridan County, Wyoming, USA. You waive any right to participate in class action lawsuits against Streamash LLC.
